Cassidy Releases 340B Discussion Draft – Senate Health, Education, Labor, and Pensions Committee Chair Bill Cassidy, MD has released a discussion draft of legislation to reform the 340B drug pricing program. The 340B Drug Pricing Integrity and Affordability for Patients Act would clarify key definitions related to the program, create transparency and reporting requirements around how 340B revenue is being used, operationalize a new sliding fee scale for low-income patients being served by hospital covered entities, reform the 340B Prime Vendor Program, and address covered entity eligibility and contract pharmacy practices. The draft bill follows a year-long investigation into different aspects of the 340B program by Sen. Cassidy, who previously released a report on how covered entities use and generate revenue from 340B and convened a committee hearing on the subject. Cassidy is requesting stakeholder feedback on the proposal be sent to [email protected] by August 28, 2026.

 

Democrats Ask NIH Director to Oppose OMB Changes to Federal Grantmaking – Democratic leaders of the House Energy and Commerce Committee have sent a letter to the National Institutes of Health (NIH) regarding proposed revisions to the Guidance for Federal Financial Assistance. The lawmakers argue that the proposal from the Office of Management and Budget (OMB) will undermine scientific integrity and politicize grant funding decisions at the NIH. “The damage of this obvious power grab by political leadership in the Trump administration threatens to inflict severe harm on the nation’s biomedical research enterprise by usurping the critical role of scientific experts in the approval and funding of grants at NIH,” the letter states. “We fear this rule will lead to fewer cures, fewer clinical trials, and more exposure to dangerous public health hazards.” The lawmakers urge NIH Director Jay Bhattacharya, MD to demand that the proposed rule be rescinded.

 

Buddy Carter Urges AMA to Reconsider Change to Maternity Billing Policy – Rep. Buddy Carter, BSPharm (R-Ga.) has sent a letter to the American Medical Association (AMA) expressing opposition to the group’s decision to change how doctors are reimbursed for maternity care. The AMA has proposed to replace the existing bundled maternity care CPT framework with individually billable services starting January 1, 2027. “This is not a routine coding update,” Rep. Carter writes. “It is a fundamental restructuring of how maternity care is reimbursed throughout the American healthcare system. The AMA has advanced this change despite serious concerns regarding affordability, care coordination, administrative burden, wasteful spending, and its inconsistency with broader healthcare efforts to move toward value-based care.”

 

Espaillat, Goldman Lose NY Reelection Bids – Rep. Adriano Espaillat lost his race in the Democratic primary for New York’s 13th Congressional District. Espaillat is the chair of the Congressional Hispanic Caucus who currently serves on the Appropriations Committee. He conceded the race to progressive activist Darializa Avila Chevalier. Rep. Dan Goldman was also defeated in the New York Democratic congressional primary last week. Goldman, who was first elected to Congress in 2022, currently serves on the Judiciary and Homeland Security committees. He was defeated by former New York City Comptroller Brad Lander.

 

Judge Temporarily Blocks Change to Professional Degree Definition – A federal judge has temporarily blocked the Trump administration’s narrowed definition of professional degree. The decision relates to the recently finalized rule from the Department of Education implementing new caps on borrowing limits for graduate and professional degree programs, as established by the One Big Beautiful Bill Act. The rule excluded certain graduate level clinical programs – such as nursing, physician assistant, occupational therapy, and physical therapy – from the definition of professional degree. U.S. District Judge Beryl Howell ruled that the addition of requirements to the definition of professional degree is in violation of the Administrative Procedure Act. The change was set to go into effect on July 1. A coalition of healthcare professionals are suing the administration, arguing that the change will irreparably harm students in impacted programs. Last week’s court decision will block implementation of the narrowed definition while the case proceeds.

 

President Taps Chris Klomp for HHS Deputy Secretary – The President has nominated Chris Klomp to serve as deputy secretary of the U.S. Department of Health and Human Services (HHS). The number two position at HHS has been vacant since the departure of Jim O’Neill in February. Klomp, a tech entrepreneur, currently serves as HHS chief counselor and director of Medicare at the Centers for Medicare and Medicaid Services. His nomination will be considered by the Senate Finance Committee.

 

Names Emerge to Lead FDA – The White House is reportedly considering tapping Heidi Overton, MD to serve as the next commissioner of Food and Drugs. Overton, a medical doctor with a doctorate in clinical investigation, is a deputy assistant to the President for domestic policy working on health issues. She previously worked at the America First Policy Institute. The Food and Drug Administration (FDA) has been without a permanent leader since Marty Makary, MD resigned in May. Other candidates reportedly under consideration for the top position include cancer physician Jeff Vacirca, MD and Principal Deputy Assistant Secretary of War for Health Affairs Stephen Ferrara, MD. The administration is expected to announce an FDA senior leadership team at the same time as the commissioner nominee.
